Do I need a fence permit around Conroe?

It depends on which city or county your lot is really in. A jurisdiction-by-jurisdiction look at what's on record and who to call.

By the 76 Fence of Conroe team · Updated

Short answer: It depends on which government your lot actually sits in, and the mailing address won't tell you. Inside Conroe, Willis, Panorama Village, Huntsville, or Cleveland, the city's fence rules apply. Out in unincorporated Montgomery County, a fence outside the floodplain generally doesn't need a county permit, though deed restrictions, an HOA, and SJRA or TRA rules on lake lots still can.

Step one: find your jurisdiction

Conroe ZIP codes reach far past the city limits. Many newer subdivisions and much of the lake shore sit in unincorporated Montgomery County. Panorama Village is a separate city even though its mail says Conroe, and several east-shore lake communities with Willis addresses appear to sit outside Willis city limits. Your appraisal district record or a call to the city settles it, and we confirm it before the quote is final.

What's on record, city by city

JurisdictionWhat we knowWho to ask
City of ConroeFence rules sit in Chapter 14, Article XI of the city code. News coverage of a 2015 ordinance described a 4-foot limit and see-through design for front-yard fences. Confirm the current wording before planning anything in front of the house.Building Inspections and Permits, 936-522-3610, Permits@cityofconroe.org
City of WillisPermit fees on the city’s schedule: $75 for a wood or chain link fence, $175 for a masonry wall, and double either amount when building begins without the permit. The posted code may trail recent amendments.City of Willis permits
Panorama VillagePermit required: $100 plus $50 per re-inspection, a plot plan with lot lines and setbacks, and a Planning & Zoning decision within 30 days. On golf-course lots, the fence has to be 48 inches tall in black wrought iron or black aluminum. No barbed or woven wire, no chain link facing the course, and no fence running from the front or side of the house toward the street.City Hall, (936) 856-2821
City of ClevelandPermit required. Up to 8 feet in side and rear yards and 6 feet in front, and any front section over 4 feet must be at least 75 percent open. Barbed wire, razor wire, chicken wire, and plywood are on the banned list.City permits, 907 E. Houston St.
City of HuntsvilleFence standards are in the city's Development Code. We confirm the current requirements for each address.City of Huntsville building permits
Unincorporated Montgomery CountyThe county's development permit is tied to enclosed structures, and its FAQ doesn't mention fences. In the 100-year floodplain, a floodplain permit may apply.County permitting and floodplain offices
Unincorporated Walker CountyFloodplain development permits apply to changes in mapped flood areas. We check for acreage around Huntsville.Walker County floodplain administrator

Codes change, so treat the table as a starting point. We confirm with the office for your lot.

The layers on top of a permit

A city permit and an HOA approval are separate reviews. In Grand Central Park, Artavia, Mavera, or Harper's Preserve, the architectural committee looks at the fence whatever the city requires. On the Lake Conroe shore, SJRA rules govern land below the 201-foot contour. On Lake Livingston, shoreline work goes through the Trinity River Authority, and the lot itself may be in Polk, San Jacinto, Walker, or Trinity County. See flood zones and easements for those limits.

Pools add one more set. Cleveland has adopted the 2015 International Swimming Pool and Spa Code, and Panorama Village requires pool fences under its adopted codes. Our pool enclosure page covers the build side.

Don't dig before the permit

Starting early costs money in some places: a Willis fence started before its permit pays double. We tell you which approvals your address needs, and any permit fee, before you sign. For local detail, see our Panorama Village and Willis pages.

Questions

Quick answers

Do I need a permit to repair my fence?

It depends on the city and how much of the fence is being replaced. A few boards are one thing, and a full rebuild is another. We check for your address when we quote the repair.

Who applies for the permit, me or you?

That varies by city. Some want the owner’s signature and some accept the contractor’s application. We tell you what your city needs and help put together the plot plan or site sketch.

Does a city permit mean my HOA is fine with the fence?

No. The city and the HOA review separately, and approval from one doesn’t stand in for the other. See HOA fencing for how the committee side works.
